How Remote Mediation Works — and Why It's Just as Effective

Skeptical about resolving a serious dispute over video? Here's why remote mediation produces the same quality outcomes as in-person sessions.

When we tell clients that all of our mediations are conducted remotely, the reaction is often skepticism. Can you really resolve a serious franchise dispute over a video call? The answer, based on hundreds of remote mediations, is yes — and in many ways, remote mediation produces better outcomes.

The logistics of in-person mediation create friction. Scheduling a day when both parties, their counsel, and the mediator can be in the same city is difficult. Travel costs add up. The formality of a conference room can make parties defensive. Remote mediation eliminates all of this.

Our remote sessions use secure, HIPAA-compliant video conferencing with separate virtual breakout rooms for private caucuses. The mediator moves between rooms exactly as they would in person. The process is identical; only the medium changes.

Research on remote mediation consistently shows that settlement rates are comparable to in-person sessions. Parties often feel more comfortable in their own environment, which can make them more open to negotiation. The absence of travel fatigue means sessions stay productive longer.

For franchise disputes — which often involve parties in different states — remote mediation is particularly practical. There's no need to agree on a neutral city, no travel costs, and no scheduling delays. We can begin the process within days of your inquiry. Contact us to get started.
